Questions about this case

 

Mrs Irvine was seen by a carer between 7am and 7.30am on the morning of her death.  She was found dead at 4.50pm by another carer.

 

Over EIGHT hours had passed from breakfast till Mrs Irvine was found dead. Who was meant to be going into give her lunch and why didn’t they?  Surely 8 hours is way to long to leave someone who is frail and infirm without as much as a cup of tea.

Mrs Irvine had told Mrs McQuarrie to leave the door unlocked to allow other persons to enter the house.

Who was Mrs Irvine expecting?

Mrs Irvine was found with her hands tied behind her back by a leather belt.

Where did the leather belt come from? Was it Mrs Irvines?  Lord Hardie said it was PIECES of a leather belt.  Where did the pieces come from?

Also did finger prints get taken of everything moved?

The electricity supply was turned off. The electric box was in the kitchen.

Would it not have taken some knowledge of the layout of the house to know where this box was? Everyone’s boxes are in different places. Most seem to be in the hallway under stairs or in cupboards.

If this was a robbery. What did the robbers get? What was it they were looking for?  They didn’t attempt to get into the wardrobe and there was £8,150 in there.  So what was it these robbers where looking for?

 

Mrs Irvine told Mrs McQuarrie she was going to have a lie in. So she perhaps lay for another half hour or so and began to get up. The first thing she would have done would be to put her teeth in.  She was sitting on the edge of the bed when the intruders came in it seems.

So she must have seen this person/people. She perhaps knew them? Is this why her face was covered?

The Pathologist.  He says he cannot tell the exact time of death. The prosecutor says it’s around 8am give or take two hours.   If that is the case, didn’t Mrs McQuarrie see anything odd or anyone hanging around when she left?  She was with Mrs Irvine until 7.30am.  Surely the pathologist can say to a more accurate estimate the time of death? Mrs Irvine ate half a bread roll at around 7.15am, her digestion system would not have completed digesting this if this had happened so soon after she ate it.

 

Another point is that if someone had planned this, they would have known the routine for Mrs Irvine. They would know the home help went in at a certain time and then would have known that once the first home help left, that they had several hours to complete what they wanted to do.

 

Mrs McCartney said she saw a man of around 5ft 10 to 5ft 11 in Mrs Irvine’s kitchen about 10am. She heard him shout, “are you there?”

 

Who did Mrs McCartney think it was? Because if this did not concern her then it must have been someone whom she thought should be there?

 

Gary Raymond says he and Colin Miller where laying flooring for a lady. Did this lady see Mr Miller hit Mr Raymond with a hammer?

Who was the text from that drove Miller into a rage? What did it say? Who was Miller calling? Why did he react so violently?

 Mrs Connell says one thing in court and another to media.  She says she found Mrs Irvine and described how she found her then called police. But on 1st October 2003 she told the Scotsman,

"I called and the door was lying open. When she didn’t answer I contacted the police and they found her."

 

Colin Miller was charged a whole year after Brendan Dixon and Patrick Docherty. All were bailed for over a year before the trial.

 Is it common practice for people under such serious charges to be bailed?

The forensics officer who did the first examination, was asked to take more swabs from the victim's hands on October 14th 2003. She stated she was unhappy to do this fearing the risk of cross contamination.

No DNA or fingerprints were identified as being that of Patrick Docherty, Brtendan Dixon or Colin Miller.
